Section R12-15-1222 - Right of ReviewA. An applicant or owner aggrieved by a decision of the Director regarding the determination of hazard classification, jurisdictional status, or the Director's application of this Article may seek review of an appealable agency action under A.R.S. Title 41, Chapter 6, Article 10.B. An applicant or owner aggrieved by a decision of the Director that requires the exercise of professional engineering judgment or discretion or the assessment of risk to human life or property, such as the adequacy of an applicant's project documentation, dam design, safe storage level, requirements for existing dams, or maintenance, may seek review by a board of review under A.R.S. §§ 45-1210 and 45-1211.C. The following actions are not subject to review:1. Emergency measures taken under A.R.S. §§ 45-1212 or 45-1221.2. Agency decisions made under A.R.S. §§ 41-1009(E) or (F).3.
