Section 8 AAC 90.187 - Decision from hearing on cancellation of certificate of fitness(a) The hearing officer will prepare a written recommendation to the director containing findings of fact and conclusions of law. A copy of the recommendations will be mailed or otherwise delivered to the respondent and to the complainant, if any. The director may accept the recommendations, in part or in whole, or may remand the matter for further hearing. The director must act upon the hearing officer's recommendation and render a decision within 30 days of receiving the recommendation from the hearing officer.(b) Upon making a decision, the director will serve it upon the respondent and complainant, if any, by personal service or certified mail.(c) A person whose certificate of fitness has been cancelled shall return the certificate to the director within 30 days after the date of personal service or the certified mailing of the decision that the person's certificate has been cancelled.Eff. 12/25/98, Register 148Authority:AS 18.62.040
