Section 8 AAC 97.225 - Complaints or accusations by employees(a) Before a represented employee may file a complaint or accusation against a labor organization or employee association under this chapter, the employee must exhaust all remedies available through the internal review procedures of the labor organization or association.(b) Before a represented employee may file a complaint or accusation against an employer under this chapter, the employee must(1) meet the requirements of (a) of this section; and(2) prove under AS 23.40.110(c) or AS 42.40.760(c) that the labor organization or employee association committed an unfair labor practice.(c) In this section, "represented employee" means(1) a public employee in a bargaining unit;(2) a former public employee who alleges that the labor organization or employee association committed an unfair labor practice during the time the employee was in the bargaining unit.Eff. 4/14/95, Register 134; am 5/20/2007, Register 182Authority:AS 23.05.380
