Section 7 AAC 80.070 - Public health service grantees and contractors(a) The provisions of 7 AAC 80.010 - 7 AAC 80.090 and 7 AAC 80.900 - 7 AAC 80.990 apply to all recipients of department grants or contracts to provide public health services. If a department grantee or contractor is providing a public health service, the term "department" in 7 AAC 80.010 - 7 AAC 80.060 and 7 AAC 80.090 is to be read as "grantee" or "contractor."(b) A public health service grantee or contractor shall charge the public health service fees that are established in 7 AAC 80.010 - 7 AAC 80.090 unless, for good cause shown as determined by the department, the department approves an alternate established fee schedule. Nothing in this subsection prevents the reduction of established fees as provided in 7 AAC 80.050, or the public interest waiver of established fees as provided in 7 AAC 80.060.(c) The public health service fees collected by a grantee are grant income under 7 AAC 78.210, may be used by the grantee to pay only those costs allowed under 7 AAC 78, and are subject to the audit requirements set out at 2 AAC 45.010 and 7 AAC 78.230.(d) The requirements of 7 AAC 78.210 regarding grant income, the requirements of 7 AAC 78 regarding allowed costs for which income may be used, and the audit requirements of 2 AAC 45.010 and 7 AAC 78.230 apply to public health service fees collected by a contractor.(e) The sign required by 7 AAC 78.010(k) that must be posted by a public health service grantee or contractor must be substantially similar to the sign described in that subsection.Eff. 8/19/98, Register 147Authority:AS 18.05.040
