Section 7 AAC 47.565 - Continuation of eligibility
(a) To maintain eligibility for assistance under AS 47.45.301 - 47.45.309 and 7 AAC 47.547 - 7 AAC 47.599, an individual who is absent from the state for a reason set out in AS 47.45.304(1) or (2), and who is or expects to be absent for 30 days or more,
(1) must notify the department of the reason for the extended absence;
(2) must provide a written statement from a physician that the medical treatment requires an absence from the state of 30 days or more;
(3) may not establish residency outside the state; and
(4) must demonstrate to the department's satisfaction that the individual intends to return to the state once the medical treatment is completed.
(b) An individual is no longer eligible for assistance under this section if the individual fails to return to this state within 30 days after the end of the extended absence under (a) of this section or an absence of 30 days or more under AS 47.45.304(3). In this situation, ineligibility begins with the calendar month following the calendar month in which an individual fails to return to this state.
(c) In AS 47.45.304(3), "special circumstances" means circumstances outside the individual's control.
