Section 7 AAC 45.270 - Family reporting requirement; changes; work activity participation
(a) Each applicant who has filed an identifiable application under AS 47.27.020, and each recipient, shall, within 10 days after the applicant or recipient knows of a change described in (b) of this section, contact the department to report the change. If an applicant or recipient fails, without good cause, to report within the 10-day period any change described in (b) of this section that would decrease the payment or result in ineligibility, the department will deny a deduction from earned income under 7 AAC 45.500, calculate the amount overpaid, and attempt to recoup the overpayment in accordance with 7 AAC 45.570. If a change is not reported within the 10-day period but is reported in time for the department to make the necessary adjustments in the ATAP payment, the department will find that no overpayment exists. A report may be submitted either in person, in a signed and dated writing, or by telephone.
(b) The following changes must be reported under (a) of this section:
(1) change in residence or mailing address;
(2) movement of a related person into or out of the household;
(3) change in the liquid resources of the household that causes the total liquid resources of the household to exceed $2,000;
(4) acquisition of a motor vehicle;
(5) change of $25 or more of unearned income, or change in the source of unearned income, received by a member of the ATAP economic unit;
(6) change in the employment of any member of the ATAP economic unit if
(A) the individual starts or stops a job or self-employment;
(B) the individual's rate of pay changes; or
(C) the individual's employment status changes from part-time to full-time or from full-time to part-time;
(7) change in the household's responsibility to pay any shelter cost because of a change in residence;
(8) change in the household's responsibility to pay child support.
(c) If the 10th day of the reporting period required under (a) of this section falls on a Saturday, Sunday, or state holiday, the deadline for submitting a report required by (a) of this section is the next work day for the department.
(d) After receiving a report of change under (a) of this section, the department may require an applicant or recipient to provide all information and documentation that the department determines is necessary to evaluate eligibility and calculate the ATAP benefit payment.
(e) For the purposes of this section, "good cause" means a circumstance beyond the applicant's or recipient's control that prevents the applicant or recipient from submitting a timely report. Good cause is determined by the department and may include
(1) a physical or mental illness or incapacity that is severe enough and long enough to prevent timely reporting:
(2) illiteracy; and
(3) failure of the mail to be delivered timely.
