Section 5 AAC 58.035 - Methods, means, and general provisions - Shellfish(a) Unless otherwise specified in 5 AAC 58.022 or by an emergency order issued under AS 16.05.060, the provisions of this section apply to shellfish sport fishing in the Cook Inlet - Resurrection Bay Saltwater Area.(b) The bag and possession limits for sport-harvested shellfish are not in addition to those allowed under the subsistence fishing regulations in 5 AAC 01 and 5 AAC 02 or the personal use fishing regulations in 5 AAC 77.(c) A person may not mutilate or otherwise disfigure a crab in any manner that would prevent the determination of the minimum size and sex restrictions specified in this chapter. Only whole crab, cooked or uncooked, may be taken off a vessel.(d) Notwithstanding 5 AAC 75.035(3), no more than two pots or two ring nets or a combination of one pot and one ring net per person, regardless of type, with a maximum of two pots or two ring nets or a combination of one pot and one ring net per vessel, regardless of type, may be used to take shellfish at any time, except that in the waters between the longitude of Gore Point (150° 57.85' W. long.) and the longitude of Cape Fairfield (148° 50.25' W. long.), no more than two pots or two rittu nets or a combination of one pot and one ring net per person with a maximum of six pots or six ring nets or a combination of pots and ring nets not to exceed a total of six units of gear per vessel may be used to take Tanner crab.(e) Each pot, other than shrimp pots, used to take shellfish under this chapter must have a minimum of two escape rings that are at least four and three-eighths inches in inside diameter.(f) Shrimp pots are pots with tunnel eye openings that individually are not larger than 15 inches in perimeter.(g) A pot used to take shellfish may not have any portion of the line attaching the pot to a buoy or buoys floating on the surface of the water at any time, except for that portion of the line connecting the main buoy to any auxiliary buoy or buoys.Eff. 5/6/81, Register 78; am 6/28/81, Register 78; am 6/20/82, Register 82; am 4/3/83, Register 85; am 5/31/84, Register 90; am 4/18/86, Register 98; am 6/10/89, Register 110; am 4/14/93, Register 126; am 6/1/96, Register 138; am 2/25/98, Register 145; am 8/24/2002, Register 163; am 7/16/2011, Register 199; am 6/21/2020, Register 234, July 2020Authority:AS 16.05.060
