Section 5 AAC 47.021 - Special provisions for seasons, bag, possession, annual, and size limits, and methods and means for the salt waters of the Southeast Alaska Area
(a) Unless otherwise specified through an emergency order issued under AS 16.05.060, the special provisions in this section apply in the salt waters listed. The special provisions are exceptions to the general provisions specified in 5 AAC 47.020, 5 AAC 47.030, and 5 AAC 47.035, and modify the general provisions only to the extent specified in this section.
(b) In the Yakutat vicinity:
(1) in Ankau Lagoon,
(A) the bag and possession limit for king salmon
(i) 20 inches or greater in length is one fish;
(ii) less than 20 inches in length is 10 fish;
(B) the bag and possession limit for coho salmon 16 inches or greater in length is two fish;
(C) the bag and possession limits for chum, pink, and sockeye salmon 16 inches or greater in length are a bag limit of six fish per species, and a possession limit of 12 fish per species;
(D) the bag and possession limit for salmon, other than king salmon 16 inches or less in length is 10 fish per species;
(E) from August 15 - September 30, sport fishing is prohibited east of a line from Smokehouse Point north to the mainland;
(2) repealed 5/26/2006;
(3) in the waters of Yakutat Village Lagoon shoreward of Mallett A venue, the bag and possession limit for coho salmon 16 inches or greater in length is two fish;
(4) in all waters between the longitude of Cape Suckling (144º W. long.), and a line running southwest from the western most tip of Cape Fairweather at 58º 47.89' N. lat., 137º v 56.68' W. long., to the intersection with the seaward limit of the exclusive economic zone at 56º 07.31' N. lat., 114º 44.74' W. long., sport fishing for Dungeness crab is closed;
(5) in all waters of Puget Cove, shoreward of the boundary defined by a line between 59° 33.88' N. lat., 139° 43.86' W. long., and 59º 33.83' N. lat" 139º 42.93' W. long., the bag and possession limit for coho salmon 16 inches or greater in length is two fish.
(c) In the Haines/Skagway vicinity, the waters of Chilkat Inlet north of a line extending from an ADF&G regulatory marker located approximately one mile south of Anchorage Point to an ADF&G regulatory marker located directly north of the Letnikof Cove boat ramp are closed to sport fishing for king salmon from April 15 - July 15.
(d) In the Juneau vicinity: in the waters that are adjacent to the Juneau City and Borough road system to a distance one-quarter mile offshore:
(1) rainbow and cutthroat trout, in combination, must be no less than 14 inches and no greater than 22 inches in length;
(2) the bag and possession limit for Dolly Varden is two fish;
(3) in the waters of Auke Bay, east of a line from Waydelich (Wadleigh) Creek to an ADF&G regulatory marker located approximately one-quarter mile south of the mouth of Auke Creek,
(A) sport fishing for sockeye salmon is closed;
(B) Dolly Varden may be taken only from June 1 - March 31;
(C) snagging or attempting to snag is prohibited within a 200-yard radius seaward of ADF&G regulatory markers located approximately 200 feet downstream of the Auke Creek weir; a fish hooked anywhere other than the mouth must be released immediately back into the water;
(4) repealed 7/1/2015;
(5) in the waters of Gastineau Channel within 150 feet of the Channel Wayside fishing dock located near the Macaulay Salmon Hatchery, snagging or attempting to snag is prohibited; a fish hooked anywhere other than in the mouth must be released immediately back into the water.
(e) In the waters of District 11, as described in 5 AAC 33.200(k),
(1) in a year with an allowable catch of Taku River king salmon, the commissioner shall close, by emergency order, the king salmon fishing season on April 24 and immediately reopen a king salmon fishing season in District 11, from April 25 - June 30, during which
(A) a sport fish angler may use two rods;
(B) a resident bag and possession limit is three king salmon, 28 inches or greater in length;
(C) a nonresident bag and possession limit is two king salmon, 28 inches or greater in length;
(D) a nonresident annual limit is five king salmon, 28 inches or greater in length;
(2) in a year when there is no allowable catch of Taku River king salmon, in the waters north of a line from Cooper Point to the mouth of Dorothy Creek, king salmon may be taken only from June 15 - April 15;
(3) if sport fishing for shrimp in the waters described in 5 AAC 33.200 as Section 11-A, a harvest recording form is required as specified in 5 AAC 75.016.
(f) In the waters of Mitchell Bay (Salt Lake) in the Admiralty Island vicinity, the bag and possession limit for coho salmon 16 inches or greater in length is six fish.
(g) In the Sitka vicinity:
(1) in the Sitka Sound Special Use Area, defined as that area of Sitka Sound enclosed on the north by lines from Kruzof Island at 57º 20.50' N. lat., 135º 45.17' W. long. to Chichagof Island at 57º 22.05' N. lat., 135º 43' W. long., and from Chichagof Island at 57º 22.58' N. lat., 135º 41.30' W. long. to Baranof Island at 57º 22.28' N. lat., 135º 40.95' W. long., and on the south and west by a line running from the southernmost tip of Sitka Point at 56º 59.38' N. lat., 135º 49.57' W. long. to Hanus Point at 56º 51.92' N. lat., 135º 30.50' W. long. to the green day marker in Dorothy Narrows to Baranof Island at 56º 49.28' N. lat., 135º 22.60' W. long.,
(A) repealed 7/1/2015;
(B) repealed 7/1/2015;
(C) razor clams may not be possessed or retained; all razor clams dug must be released immediately;
(D) sport fishing for shrimp is closed;
(2) the waters off Cape Edgecumbe enclosed by a box at 56º 55.50' N. lat. and 56º 57' N. lat., and 135º 54' W. long. and 135º 57' W. long. are closed to sport fishing for all species of bottomfish, as defined in 5 AAC 39.975, and halibut;
(3) the Bear Cove Special Harvest Area, described as those waters of Bear Cove east of a line between ADF&G regulatory markers located on the north and south shores of Bear Cove, is closed to snagging; a fish hooked anywhere other than the mouth must be released immediately;
(4) repealed 7/13/ 2012;
(5) as specified in 5 AAC 01.760, in Redoubt Bay
(A) the bag and possession limit for sockeye salmon is four fish;
(B) from June 1 - July 15, snagging is not allowed in the waters south of 56º 54.71' N. lat.;
(C) from July 16 - August 31, snagging is not allowed by a nonresident in the waters south of 56º 54.71' N. lat.;
(6) in Mist Cove, south of a line from ADF&G regulatory markers located at 56º 31.07' N. lat., 134º 40.20' W. long. to 56º 31.07' N. lat., 134º 40.12' W. long., sport fishing for salmon is closed;
(7) in Kasnyku Bay, north and west of a line from ADF&G regulatory markers located at 57º 13. 17' N. lat., 134º 51.86' W. long. to 57º 13.08' N. lat., 134º 52.02' W. long. and north of a line from 57º 13.05' N. lat., 134º 52.24' W. long. to 57º 13.06' N. lat., 134º 52.20' W. long., sport fishing for salmon is closed.
(8) in waters of Central Southeast Outside (CSEO) Section, as described in 5 AAC 28.105(a)(4)(B), the bag limit for nonresidents for pelagic rockfish is three fish, possession limit of six fish, no size limit.
(h) Repealed 5/12/2011.
(i) In the Prince of Wales Island vicinity,
(1) all waters of Klawock Harbor south of a line from the Klawock blinker light to the Klawock Cannery Dock are closed to
(A) snagging; a fish hooked anywhere other than the mouth must be released immediately;
(B) sport fishing for sockeye salmon;
(2) shrimp may not be taken in the waters of Twelve-Mile Arm west of a line from Prince of Wales Island at 55º 29.07' N. lat., 132º 37.60' W. long., to the northeasternmost tip of Loy Island at 55º 29.07' N. lat., 132º 36.70' W. long., to the easternmost tip of Cat Island at 55º 27.80' N. lat., 132º 39.08' W. long., to Prince of Wales Island at 55º 27.80' N. lat., 132º 40.93' W. long., including the waters of Hollis Anchorage;
(3) Dungeness crab may not be taken in the waters of Klawock Inlet, Shinaku Inlet or Big Salt Lake, northeast of a line from Prince of Wales Island at 55º 31.20' N. lat., 133º 07.63' W. long., to Prince of Wales Island at 55º 34.72' N. lat., 133º 13.38' W. long.;
(4) Dungeness crab may not be taken in the waters of Coffman Cove south and west of a line extending from a point at 56º 01.35' N. lat., 132º 49.67' W. long., to a point located at 56º 01.71' N. lat., 132º 51.01' W. long.;
(5) Dungeness crab may not be taken in the waters near Whale Pass north and west of a line extending from a point at 56º 05.81' N. lat., 133º 06.52' W. long., to a point located at 56º 05.62' N. lat., 133º 07.33' W. long.
(j) In the Ketchikan vicinity:
(1) repealed 7/1/2015;
(2) Behm Canal and the contiguous bays and enclosed by a line from Point Eva to Cactus Point, a line from Point Lees to Elsie Point, and a line between ADF&G regulatory markers located at the longitude of the outlet of Long Lake (131º 26.15' W. long.), are closed to sport fishing for salmon;
(3) in Behm Canal and the contiguous bays between a line from Point Eva to Cactus Point and the latitude of Point Nelson (55º 18.00' N. lat.), salmon may be taken only from August 15 - April 30;
(4) in Neets Bay east of a line between ADF&G regulatory markers located approximately one mile from the head of the bay, salmon may be taken only from November 16 - June 14;
(5) in Thomas Basin seaward of a line between ADF&G regulatory markers located on the upstream side of the Stedman Street Bridge,
(A) only single hooks may used;
(B) snagging is prohibited; a fish hooked anywhere other than the mouth must be released immediately;
(6) shrimp may not be taken in the waters east of a line from Indian Point at 55º 36.85' N. lat., 131º 42.02' W. long., to the northeasternmost tip of Betton Island at 55º 31.95' N. lat., 131º 46.37' W. long., to the southeasternmost tip of Betton Island at 55º 29.90' N. lat., 131º 48.18' W. long., to Survey Point at 55º 28.07' N. lat., 131º 49.87' W. long.
(k) When the commissioner determines that it is necessary for the conservation of king salmon stocks in the Unuk, Chilkat, or King Salmon Rivers, the commissioner may, by emergency order, close the fishing season in appropriate areas and immediately reopen a season with king salmon annual limits, established pursuant to 5 AAC 75.003, for residents and nonresidents; when annual limits are established under this subsection a harvest record is required as specified in 5 AAC 75.006.
