Section 21 AAC 25.150 - Subpoenas
(a) A subpoena issued under AS 24.55.170 may be served by any member of the ombudsman's staffer by any person authorized under Alaska Rule of Civil Procedure 45 to serve a subpoena. Service of a subpoena upon a person named in it shall be made by delivering a copy of the subpoena to the person. Proof of service shall be established by affidavit of the person who served the subpoena at or about the time service is made. A subpoena may also be served by registered or certified mail. In such case the ombudsman shall mail the subpoena for delivery only to the person subpoenaed, and the returned delivery receipt shall be addressed so that it is returned to the ombudsman and shall constituteproof of service.
(b) The ombudsman will pay witness fees aiid expenses as set forth by the Alaska Rules of Court Administrative Rules. However, the ombudsman will not pay a witness fee or reimburse expenses for an employee of an agency who complies with a subpoena in the employee's official capacity, unless the employee is required to travel more than 50 miles from the employee's place of business in order to comply with the subpoena.
