Section 2 AAC 40.075 - Monthly payment of bonuses(a) Bonuses will be issued only to individuals who satisfy the validation procedures of 2 AAC 40.080.(b) A bonus will be mailed to each qualified individual. Mailing of bonuses will be scheduled so that payments are received near the first of each month. No payment will be mailed to an address outside Alaska unless(1) the United States Postal Service requires the use of an FPO/APO address in order to deliver mail to certain locations in Alaska; or(2) the recipient has notified the administrator that he or she has discontinued residency in Alaska and the payment is for a month for which a recipient is qualified to receive a bonus payment.(c) Unless other reimbursement is received by the administrator, bonus payments will be withheld as repayment for bonuses that were issued to a recipient for a period in which the recipient was not entitled to receive a bonus payment.Eff. 12/1/90, Register 117; am 3/6/92, Register 122The 3/6/92 "emergency" amendment to 2 AAC 40.075 was published in the emergency regulations section of the July 1992 Cumulative Supplement pamphlet for 2 AAC. Appearing below the section was a statement that the emergency regulation expired July 3, 1992, unless made permanent by the adopting agency. That statement was incorrect. The adoption of longevity bonus regulations is exempt from the Administrative Procedure Act (AS 44.62) and that Act's emergency regulation expiration provision, and no other regulation adoption requirements are provided for those regulations. Therefore, the 3/6/92 "emergency" amendment to 2 AAC 40.075 remained in effect without the need for further agency action.
