Section 18 AAC 83.540 - Mass limitations(a) In a permit, any limitation, standard, or prohibition of a pollutant must be expressed in terms of mass, except (1) pH, temperature, radiation, or other pollutants that cannot appropriately be expressed by mass; or(2) if applicable standards and limitations are expressed in terms of other units of measurement.(b) If, in establishing permit limitations on a case-by-case basis, the department finds a limitation expressed in terms of mass is infeasible because the mass of the pollutant discharged cannot be related to a measure of operation, such as a discharge of total suspended solids from certain mining operations, the department will limit the pollutant through another appropriate unit of measurement. In this case, the department will include permit conditions to ensure that dilution will not be used as a substitute for treatment.(c) A pollutant limited in terms of mass may also be limited in terms of other units of measurement, and the permit must require the permittee to comply with both limitations.Eff. 7/29/2006, Register 179Authority:AS 44.46.020
