Section 18 AAC 78.220 - Initial response(a) Upon confirmation of a release in accordance with 18 AAC 78 .2 10 or after a release from the UST is identified in any other manner, the owner or operator of a UST shall report the release as specified under 18 AAC 78.2 12 and perform the following initial response actions not later than 24 hours after discovery of a release: (1) the owner or operator shall take immediate action to prevent any further release of the petroleum into the environment, including removal of the petroleum from the UST if removal is necessary to meet the requirements of this paragraph; and(2) the owner or operator shall identify and mitigate any fire, explosion, or vapor hazard.(b) Unless directed to do otherwise by the department, the owner or operator shall conduct initial abatement, release investigation, and corrective action as required under 18 AAC 78.230 - 18 AAC 78.270.Eff. 3/25/91, Register 118; am 8/21/91, Register 119; am 11/3/95, Register 136; am 1/22/99, Register 149; am 9/27/2018,Register 227, October 2018Authority:AS 46.03.020
