Section 13 AAC 09.900 - Definitions(a) In this chapter and AS 12.63, unless the context requires otherwise,(1) "Alaska state trooper post" means a permanent office of the department's division of Alaska state troopers or division of Alaska wildlife troopers;(2) "electronic mail address" means a destination, commonly expressed as a string of characters, consisting of a unique user name or mailbox and a reference to an Internet domain, whether or not displayed, to which an electronic mail message can be sent or delivered;(3) "instant messaging address" means any identifier that allows a person to communicate in real time with another person using the Internet;(4) "Internet" means collectively the myriad of computer and telecommunications facilities, including equipment and operating software, that comprise the interconnected world-wide network of networks that employ the Transmission Control Protocol/Internet Protocol, or any predecessor or successor protocols to that protocol, to communicate information of all kinds by wire or radio;(5) "jurisdiction" means (B) the District of Columbia;(C) the Commonwealth of Puerto Rico;(F) the Northern Mariana Islands;(G) the United States Virgin Islands; and(H) Indian tribes that have elected to function as a registration jurisdiction under 42 U.S.C. 16927 (Sex Offender Registration and Notification Act);(6) "other Internet communication identifier" means any designation defining a person that is used for the purposes of chat room discussions, instant messaging, social networking, or other similar electronic communication.(b) In this chapter, unless the context requires otherwise, (1) "conviction" has the meaning given in AS 12.63.100;(2) "days" means calendar days;(3) "department" means the Department of Public Safety;(4) "offender" means a person required to comply with registration requirements under AS 12.63; "offender" includes both a sex offender and a child kidnapper;(5) "offense" means a conviction for which a person is required to register under AS 12.63;(6) "registration agency" means (A) for an offender who is incarcerated in a state correctional facility, the state correctional facility in which the offender is incarcerated;(B) for an offender who is not incarcerated in a state correctional facility (i) if the offender's residence address is in the Municipality of Anchorage, the department's central registry of sex offenders and child kidnappers in Anchorage;(ii) if the offender's residence address is outside the Municipality of Anchorage, the Alaska state trooper post or municipal police department nearest to the offender's residence address;(7) "registration program" means a system of registration that qualifies for federal funding under 42 U.S.C. 14071 (Jacob Wetterling Crimes Against Children and Sexually Violent Offender Registration Program Act);(8) "state correctional facility" has the meaning given in AS 33.30.901;(9) "unconditional discharge" has the meaning given in AS 12.55.185;(10) "chat room" means any Internet service through which a number of users can communicate in real time so that communications are almost immediately available to all other users or to a designated segment of all other users;(11) "social networking" means an Internet website that(A) allows users, through the creation of web pages or profiles or other means, to provide information about themselves that is available publicly or to other users; and(B) offers a means of communication with other users, such as a forum, chat room, electronic mail, or instant messaging.(c) In AS 18.65.087, "another reliable source" includes, upon verification by the department, the following: (1) a court of another jurisdiction;(2) the victim of the offense or a member of the victim's family;(3) an employer of the offender;(4) an acquaintance or a neighbor of the offender;(5) a member of the offender's family.Eff. 12/31/95, Register 136; am 11/3/99, Register 152; am 4/15/2009, Register 190As of Register 152, January 2000, the paragraphs of 13 AAC 09.900(b) have been rearranged to maintain alphabetical order, integrating new paragraphs, and to eliminate gaps created by the repeal of some previous paragraphs.
