Section 950-1-2-.07 - Effective Date

The original effective date adopting the Interstate Compact on Juveniles was October 1, 1965, through Act 675, 1965 Regular Session of the Alabama Legislature, and designating the Commissioner of the Department of Pensions and Security as Compact Administrator.

(a) Authority for Administration of the Interstate Compact on Juveniles was first given to the Department of Youth Services on September 5, 1973, by Act 816.
(b) Administration of the Interstate Compact on Juveniles was assumed by the Department of Youth Services July 1, 1974.
(c) The legislation repealed the original compact and adopted the new compact by Act 2014 313 effective July 1, 2004 and the department immediately assumed administration.

I understand that the very fact that supervision will be in another state makes it likely that there will be certain differences between the supervision I would receive in this state and supervision which I will receive in any state to which I am asking to go. However, I urge the authorities to whom this application is made, and all other judicial and administrative authorities, to recognize that supervision in another state, if granted as requested in this application, will be a benefit to me and will improve my opportunities to make a good adjustment. It should be used in all Compact cases where applicable. Form 1A should accompany Juvenile Compact Form IV. Five copies of this should be made: one copy to be given the juvenile, two copies to the other state, one copy for the State Office, and one copy for the county. INSTRUCTIONS This form should be typed. To: Enter here the court and judge granting parole to the juvenile. I, ________: Enter the full name of the juvenile who is applying for Compact services. Signed ______________________________ Judge REQUISITION FOR RUNAWAY JUVENILE DYS-ICJ-11 JUVENILE COMPACT FORM 1 This form is used when it becomes necessary for the court to take action in having a runaway juvenile returned to Alabama. The form must be executed by the Court from whose jurisdiction the juvenile has fled. Form 1 is to be used only in cases where the youth refuses to return home or where there is some question of legality of the youth's return to his home state. This requisition can be used only for non-delinquent runaway juveniles. Minimum copies for the State of Alabama should be four. One copy is to be retained by the court, one copy to the Compact Administrator of the requisitioning state, one copy to the Compact Administrator of the state where the runaway is located, and one copy to the appropriate court or executive authority of the state where the runaway is located. The form and copies should be routed through the Department of Youth Services for forwarding. INSTRUCTIONS This form should be typed. Form III is protection for the authorities who are responsible for sending the youth back to his home state. Five copies of this form should be completed: one copy for the court, one copy to the juvenile, two copies to the Compact Administrator in the requisitioning state, and one copy to the Compact Administrator in the state where the juvenile is being held. PAROLE OR PROBATION INVESTIGATION REPORT DYS-ICJ-13 Juvenile Compact Form IV This form is used in all cases in which Alabama is requesting a home investigation for possible placement of a parolee or probationer in another state. This is the initial referral form which is used instead of a letter of request. Accompanying this form should be a social summary, any test results, court records, and pertinent court orders. Compact Form 1A, Application for Compact Services, should be sent with Form IV and other material. Four (4) copies of this form should be completed for distribution: one copy to be retained in the county, one copy for the State Office, and two copies for the proposed receiving state. INSTRUCTIONS This form should be typed. Reply to: Enter the name and address of the Director, Alabama State Department of Youth Services. To: Enter here the name of the Compact Administrator of the receiving state and his title. Date: Enter the date that this form is being completed. Check the appropriate space marked parole-probation. Our file No.: Enter the county case number, or if this form is being initiated from a training school, the institution's file number should be shown in this space. Four copies of this form should be made: one to be retained, one copy sent to the State Office, and two copies to be sent to the other state. INSTRUCTIONS Reply to: Enter the name and address of the Director, Alabama State Department of Youth Services. To: Enter the name and title of the Compact Administrator of the receiving state. Date: Enter the date the form is being completed. Check the appropriate item - probation or parole, whichever is applicable. Our File No.: Enter the county case number. If the form is being completed at a training school, that institution's file number should be entered. Re: Enter the full name of the juvenile who is being transferred. The above mentioned will depart from: Enter the city from which the juvenile will leave this state. By: Indicate whether the juvenile will be traveling by bus, automobile, or air. On: Enter the exact date/s of travel of the juvenile. Indicate, by underlining the appropriate phrase, in what manner the juvenile is to initiate contact with the authorities of the other state (in person or by letter). It is used to determine that the youth understands the terms of his probation or parole and that he is to return to Alabama if for some reason we recall him or he breaks his probation or parole. Form VI should always accompany Compact Form V. Five (5) copies of this form should be made: one copy to be given the juvenile, one copy to be retained in the county case record, one to the State Office, and two copies to be sent to the receiving state. ORDER OF DETENTION DYS-ICJ-20 Juvenile Compact Form B This form is to be used by the court when a requisition has been issued for the return of a runaway, escapee or absconder. Five (5) copies of this form should be completed: one copy to be retained by the court, one copy to appropriate peace officer who will take the juvenile into custody, one copy for the county case record, one copy for the state office, and one copy for the other state. INSTRUCTIONS This form should be typed. Reply to: Enter the name and address of the Director, Alabama State Department of Youth Services. Name of Juvenile: Enter the full name of the juvenile to be detained. On the three lines following the juvenile's name, enter the information called for in the instructions immediately following the lines....and whose return is being sought by: Enter the court name in the state where the child is located. When using this form, we would always enter an Alabama court name....in the State of: Enter the name of the demanding state. The form should be signed and formalized by the court or executive authority to whom the demanding state has addressed a requisition.
