Section 880-X-10C-.65 - Cessation Of Operations: Permanent

(1) Persons who cease surface mining activities permanently shall close or backfill or otherwise permanently reclaim all areas, in accordance with these regulations and the permit approved by the State Regulatory Authority.

(2) All underground openings, equipment, structures, or other facilities not required for monitorings unless approved by the State Regulatory Authority as suitable for the Postmining land use or environmental monitoring, shall be removed and the affected land reclaimed.

(3) The permittee shall notify the State Regulatory Authority of cessation of mining activity within 30 days of cessation of operations.
