Any person substantially affected by a rule or regulation of the Board may request a declaratory ruling with respect to the validity or applicability of the rule or regulation and any person substantially affected by the statute implemented, administered and enforced by the Board may request a declaratory ruling with respect to the applicability of such statute by submitting such request in writing to the Board stating with particularity facts sufficient to show such person is substantially affected by the rule or statute. Such request should precisely state the question or questions with respect to which a declaratory ruling is sought. The Board shall issue declaratory rulings in its discretion when the Board deems such a ruling to be necessary and appropriate.
