Section 800-3-1-.01 - Appeals
(1) Any person dissatisfied with any action by the administration of the Judicial Retirement Fund may appeal by filing a written appeal to the secretary-treasurer or the chairman of the Board of Control of the Employees' Retirement System.
(a) The appeal must distinctly set forth the questions and issues involved and must state the reasons why the decision complained of is alleged to be erroneous;
(b) Written appeals must be filed within 60 days of notification of the decision.
(2) Whenever a hearing is requested before the Board of Control, such hearing shall be held at the next Board meeting.
(a) Appeals shall be received not less than ten days before a meeting to be placed on the agenda;
(b) Arguments should be limited to 15 minutes and shall be confined to the issues made by the record and evidence transmitted by the appellant;
(c) The Board of Control shall not consider any questions not specifically made in the written appeal;
(d) The Board may in any case require the personal appearance of the appellant to question him or her concerning his or her contentions.
