Section 660-5-43-.02 - Eligibility(1) To be eligible for adult day care, an adult recipient must meet one of the priorities listed. Priorities will be given in the following order: (a) Persons for whom day care is an appropriate part of a case plan and who are at risk of abuse, neglect, or exploitation or(b) Persons for whom day care is an appropriate part of the case plan and who are at risk of institutionalization.(2) When waiting lists must be established for receipt of day care service, these same priorities will be used (in order listed) for removing names from the waiting list when the service becomes available. When two or more adults on the waiting list have the same priority, the date of request for the service will be used to determine which has higher priority.(3) If terminations are necessary due to funding reductions, the persons most recently authorized with the lowest priority will be the first terminated. If they continue to be eligible for the service, those terminated will go to the top of the waiting list.(4) Slots for adult day care are limited and must be allocated. Author: Kay Pilgreen
