Section 350-X-1-.10 - Penalties(1) All Certified Producers and Certified Farmers Markets are required to adhere to the rules and regulations of the Authority. The Authority may discipline the following for violating the Authority's rules and regulations:(a) The Certified Farmers Market; or(b) The Certified Producer; or(c) A family member, employee, or another Certified Producer acting on behalf of the Certified Producer; or(d) Any other person whose actions may have resulted in the violation.(2) The Authority, upon determination that a Certified Producer has violated the Authority's rules and regulations may:(a) Issue a written reprimand; or(b) Suspend a license up to six months; or(c) Revoke the Certified Producer's Certificate; and/or(d) Refuse to Certify a Producer for a period of up to 18 months.(3) The Authority, upon determination that a Certified Farmers Market has violated the Authority's rules and regulations may:(a) Fine the Market up to $1,000 per violation.(4) Disciplinary actions shall be initiated by the Director of the Authority upon belief that a violation has occurred. All persons or entities certified under these rules may appeal any disciplinary action initiated by the Director.Ala. Admin. Code r. 350-X-1-.10
