Section 335-3-16-.06 - Federally Enforceable Requirements(1) All terms in a permit that are required to be part of a permit pursuant to the Act are federally enforceable by EPA, the Department and citizens in general. However, those provisions of a permit that are not required under the Act are considered to be state permit provisions and consequently, are not federally enforceable by EPA and citizens in general.(2) Those provisions of a permit that are state provisions shall be separated from the federally enforceable terms.
