Section 305-7-7-.17 - Computation Of Time

In computing any period of time prescribed by this Chapter or by the Code of Ala. 1975, 5541-22-1, etseq., the day the administrative action is taken shall not be included. The last day of the period so computed shall be included, unless it is a Saturday, Sunday, or legal holiday, in which event the period runs until the end of the next day which is not a Saturday, Sunday, or legal holiday. A legal holiday shall be a day recognized as a legal holiday by the State of Alabama and/or as designated by the Governor of the State of Alabama. Whenever a party has the right or is required to do some act or to take some proceedings within a prescribed period after the service of a notice or other paper upon them and the notice or paper is served upon them by mail, three (3) days shall be added to the prescribed period.
