DECISION AND DIRECTION
The National Labor Relations Board has considered an objection and
determinative challenged ballots in an election held August 28 and 29, 2013, and the
Hearing Officer’s report recommending disposition of them. The election was conducted
pursuant to a Stipulated Election Agreement. The tally of ballots shows 92 ballots cast for
the Petitioner, 99 ballots cast for the Intervenor,1 and 3 ballots cast against the
participating labor organizations. There were 10 challenged ballots, a sufficient number to
affect the results.
No exceptions have been filed to the Hearing Officer’s report within the time
provided. Accordingly, the Board adopts the Hearing Officer’s findings and
recommendations.2

The Hearing Officer recommended that Petitioner’s Objection 1 be overruled in its entirety. The
Hearing Officer also recommended that the challenges to the ballots of DC Assistant Supervisors
Patrick Douglass, Rodney Ricks, and Jason Munden, and Assistant Shift Supervisor/Lead
Inventory Control Scott Renberg be sustained. She also recommended that the challenges to the
ballots of Security Gate Guards David Sweet, Joyce Higman, Jeffrey Howard, and Alejandro
Chavez, and HR Assistant Cheryl Berg and Receptionist Catherine Dubish be overruled, and their
ballots be opened and counted and that a new Tally of Ballots issue.

DIRECTION
IT IS DIRECTED that the Regional Director for Region 27 shall, within 14 days of
this direction, open and count the ballots of David Sweet, Joyce Higman, Jeffrey Howard,
Alejandro Chavez, Cheryl Berg and Catherine Dubish, and thereafter prepare and serve
on the parties a revised tally of ballots, and issue the appropriate certification.
