Pursuant to the Direction of Election, an election by secret ballot was .conducted on May 19, 1942, under the direction and supervision ,of the Regional Director for the Tenth Region (Atlanta, Georgia). On May 21, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, issued and duly served upon the parties an Election Report on the ballot. As to the balloting and its results, the Regional Director reported as follows : Total ballots cast------------------------------------------- 19 Total ballots challenged------------------------------------- 0 Total void ballots------------------------------------------ 0 Total valid votes counted------------------------------------ 19 Votes cast for Motor Transport and Allied Service Workers, Local 400, C. 1. 0----------------------------------------- 1 Votes cast for Amalgamated Meat Cutters and Butcher Work- men of North America, A. F. L----------------------------- 3 Votes cast for neither--------------------------------------- 15 Objections were filed to the conduct of the ballot but were subse- quently withdrawn. The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees. The peti- tion for investigation and certification of representatives of employees of Wilson & Company, Miami, Florida, will therefore be dismissed. 1 40 N. L. R. B. 816 41 N. L. R. B., No. 167. 937 938 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Wilson & Company, Miami, Florida, filed by Motor Transport and Allied Service Workers Local Union No. 400, affiliated with the Congress of Industrial Organ- izations, be, and it hereby is, dismissed.
