Employer and Case 32-RC-5647 NATIONAL UNION OF HEALTHCARE WORKERS Petitioner DECISION AND CERTIFICATION OF REPRESENTATIVE The National Labor Relations Board considered objections to an election held April 20, 2010, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The revised tally of ballots shows 82 ballots cast for the Petitioner, 89 ballots cast for the Intervenor', 3 votes cast for neither and 1 void ballot and no determined challenged ballots. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations, and finds that a certification of representative should be issued. SEIU-UHW (Service Employees International Union, United Healthcare Workers-West) CERTIFICATION OF REPRESENTATIVE IT IS CERTIFIED that a majority of the valid ballots have been cast for SEIU-UHW (Service Employees International Union, United Healthcare Workers-West) and that it is the exclusive collective-bargaining representative of the employees in the following appropriate unit: All full-time regular part-time certified nursing assistants, restorative nursing assistants, housekeeping employees, laundry employees, dietary aids, janitors, maintenance employees, cooks, kitchen employees, and licensed vocational nurses* (LVNs) employed by the Employer at its Willow Pass Healthcare Center located in Concord, California, at its Kyakameena Skilled Nursing Facility located in Berkeley, California, at its San Leandro Healthcare Center located in San Leandro, California, and at its Elmwood Nursing and Rehabilitation Center located in Berkeley, California; excluding all Registered Nurses (RNs), licensed vocational nurses (LVNs) at the Elmwood and Kyakameena facilities only, managerial and administrative employees, professional employees, office clerical employees, all other employees, guards, and supervisors as defined in the Act. *Licensed vocational nurses included at the Willow Pass and San Leandro facilities only.
