Employer and NATIONAL UNION OF HEALTHCARE Case 32-RC-5647 WORKERS Petitioner and SERVICE EMPLOYEES INTERNATIONAL UNION, UNITED HEALTHCARE WORKERS-WEST Intervenor CORRECTED DECISION AND ORDER The National Labor Relations Board, by a three-member panel, has considered determinative challenges in an election held on April 20, 20 10, and the Regional Director's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 82 for the Petitioner and 85 for the Invervenor, with 13 challenged ballots, a number sufficient to affect the results. The Board has reviewed the record in light of the exceptions and brief, and adopts the Regional Director's findings and recommendations. ORDER IT IS ORDERED that the Regional Director for Region 32 shall, within 14 days from the date of this Decision, open and count the ballots of Han Miang Zheng, Gurinder Gill, Jocelyn Gonzales, and Marlene Maramba, prepare and cause to be served on the parties a revised tally of ballots, and issue the appropriate certification.
