Employer and TEAMSTERS LOCAL 41, affiliated with THE INTERNATIONAL BROTHERHOOD OF TEAMSTERS Petitioner Case 14-RC-115146 DECISION AND DIRECTION The National Labor Relations Board has considered challenged ballots in an election held December 3, 2013, and the hearing officer's report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of ballots shows 3 ballots cast for the Petitioner and 4 ballots cast against the Petitioner, with 11 challenged ballots, a sufficient number to affect the results1. 1 The Board agent who conducted the election challenged the ballots of Donnie Brady, Wayne Bruington, Mike Coppoc, William Hall, Lonnie Hayes, Jerry Johnson and Tim Mills because their names were not included on the voter eligibility list. The Petitioner challenged the ballots of Evan Beard, Nick Owings, Kenny Buckler and David Powers. The Hearing Officer recommended that the challenges to the ballots of Evan Beard, Kenny Buckler, Lonnie Hayes, Jerry Johnson, Tim Mills and Nick Owings be sustained. The Hearing Officer recommended that the challenges to the ballots of Donnie Brady, Wayne Bruington, Mike Coppoc, William Hall and David Powers be overruled, that their ballots be opened and counted, and that a revised Tally of Ballots and appropriate certification be issued. 2 No exceptions have been filed to the hearing officer's report within the time provided. Accordingly, the Board adopts the hearing officer's findings and recommendations. DIRECTION IT IS DIRECTED that the Regional Director for Region 14 shall, within 14 days of this direction, open and count the ballots of Donnie Brady, Wayne Bruington, Mike Coppoc, William Hall and David Powers, and thereafter prepare and serve on the parties a revised tally of ballots, and issue the appropriate certification.
