Westinghouse Electric and Manufacturing Co.Download PDFNational Labor Relations Board - Board DecisionsAug 13, 194134 N.L.R.B. 262 (N.L.R.B. 1941) Copy Citation In the Matter Of WESTINGHOUSE ELECTRIC AND MANUFACTURING COM- PANY and LOCAL UNION B-1161, INTERNATIONAL BROTHERHOOD OF ELECTRICAL WORKERS Case No. B4547 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES August 13, 1941 On July 1, 1941, the National Labor Relations Board, herein called the Board , issued its Decision and Direction of Election in this pro- ceeding Pursuant to the Direction of Election , an election by secret ballot was conducted on July 18, 1941 , under the direction and supervision of the Regional Director for the Fourth Region ( Phila- delphia, Pennsylvania ). On July 26 , 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Rela- tions Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report - were filed by any of the parties. As to the balloting and its results , the Regional Director reported as follows : .Total on eligibility list- ------------------------------------------------- 115 Total ballots cast ------------------------------------------------------- 103 't'otal ballots counted---------------------------------------------------- 101 Ballots cast for Local Union B -1161, International Brotherhood of Elec- trical workers-------------------------------------------------------- 101 Ballots cast against Local Union B-1161, International Brotherhood of Electrical workers-- -------------------------------------------------- 0 Challenged ballots----------------------------------------------------- 0 Blank ballots----------------------------------------------------------- 0 Void ballots------------------------------------------------------------ 0 Mail ballots not counted-------------------------------------------------2 133 N L R B 97 In its Decision the Board directed that the I B E W and the United should appear upon the ballot , but that the name of the United should be omitted if , within five days from its receipt of the Direction of Election , the United did not desire to appear upon the ballot and notified the Regional Director to that effect . On July 11, 1941, the United so notified the Regional Director . The United took no part in the election 34 N L. R. B., No. 37. 262 WESTINGHOUSE ELECTRIC & MFG. CO. 263 In its Decision and Direction of Election noted above, the Board stated: "Upon the result of the election will depend, in part, our determination of a separate unit for employees at the 49th Street plant. If a majority of the employees voting designate the I. B. E. W. as their collective bargaining representative, then employees at the 49th Street plant shall constitute a single appropriate unit, and we will certify the I. B. E. W. as bargaining representative thereof." Upon the entire record in .the case, the Board makes the following : SUPPLEMENTAL FINDINGS OF FACT We find that all hourly paid employees of Westinghouse Electric and Manufacturing Company at its 49th Street plant, Philadelphia, Pennsylvania, excluding office employees, constitute a unit appro- priate for the purposes of collective bargaining and that said unit will insure to employees of the Company the full benefit of their right to self-organization and to collective bargaining and other- wise effectuate the policies of the Act. SUPPLEMENTAL CONCLUSION OF LAW All hourly paid employees of Westinghouse Electric and Manu- facturing Company at its 49th Street plant, Philadelphia, Pennsyl- vania, excluding office employees, constitute a unit appropriate for the purposes of collective bargaining within the meaning of Section 9 (b) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT Is HEREBY CERTIFIED that Local Union B-1161, International Brotherhood of Electrical Workers, has been designated and selected by a majority of all hourly paid employees of Westinghouse Electric and Manufacturing Company at its 49th Street plant, Philadelphia, Pennsylvania, excluding office employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the Act, Local Union B-1161, International Brotherhood of Electrical Workers, is the exclusive representative of all such em- ployees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
