1 In denying review, we rely solely on evidence that Service Technician Michael Vance
exercised supervisory authority to effectively recommend hiring of Lighting Maintenance
Technicians. We do not reach the Regional Director’s findings as to other supervisory indicia.
Consequently, we need not address the Petitioner’s argument that the Hearing Officer
improperly permitted witness Johnny Leach to be recalled to provide rebuttal testimony.
Because Leach’s testimony on rebuttal addressed Vance’s alleged disciplinary authority, its
inclusion in the record does not affect the outcome of this case.
