Employer and Case 5-RC-16618 UNITED SECURITY AND POLICE OFFICERS OF AMERICA (USPOA) Petitioner and INTERNATIONAL UNION, SECURITY, POLICE AND FIRE PROFESSIONALS OF AMERICA (SPFPA) Intervenor DECISION AND ORDER REMANDING The National Labor Relations Board, by a three-member panel, has considered objections to a mail ballot election held between February 1, 2011, and February 22, 2011, and the Regional Director’s report recommending disposition of them. The election was conducted pursuant to a Stipulated Election Agreement. The tally of votes shows 20 votes for the Petitioner, 2 votes for the Intervenor, and 7 votes for neither labor organization, with 2 void ballots and no challenged ballots. The Board has reviewed the record in light of the Intervenor's exceptions, and finds that the Intervenor's Objection raises substantial and material factual issues warranting further investigation and, if necessary, a hearing. In particular, the Objection raises issues with respect to whether the Employer properly posted the election notice pursuant to Sec. 103.20 of the Board's Rules and Regulations, whether there is evidence 2 that the Employer favored either party during the election process, and the relevance, if any, of such evidence. ORDER IT IS ORDERED that this proceeding is remanded to the Regional Director for further investigation and, if necessary, a hearing, consistent with our Decision.
