Case No. 13-RC-3402. Novem- ber 9, 1953 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES Pursuant to a Decision and Direction of Election dated August 14 , 1953, an election by secret ballot was duly con- ducted on September 11, 1953, by the Regional Director for the Thirteenth Region. At the request of the Intervenor , Inter- national Brotherhood of Electrical Workers, Local 1031, its name was removed from the ballot by the Regional Director. Thy choice in the election , therefore , was between the Peti- tioner and no union . The tally of ballots shows that out of ap- proximately 345 eligible voters, 210 cast votes for and 123 against the Petitioner , and that there were 8 challenged ballots. On September 13, 1953, the Intervenor filed objections to conduct affecting result of election , alleging in substance that before the election the Employer had accorded favored treat- ment to the Petitioner. On September 23, 1953, the Regional Director issued his report on objections . In it he found, inter alia, that by requesting that its name be removed from the bal- lot in the election , the Intervenor had removed itself as a party to these proceedings , and recommended that its objec- tions should not be considered . On October 2, 1953, the Inter- venor filed exceptions to the Regional Director ' s report on objections. 1 We agree with the Regional Director ' s conclusion that the Intervenor had no standing to file objections to the election herein .2 We therefore adopt the Regional Director ' s recom- mendation and hereby overrule the Intervenor ' s objections. 9 As the majority of the valid votes has been cast for the Peti- tioner, we shall certify that union as the bargaining represen- tative of the employees in the unit found appropriate. [The Board certified International Union of Electrical, Radio & Machine Workers, CIO , as the designated collective -bargain- ing representative of all production and maintenance employees of Warwick Manufacturing Corporation at its plant at Zion, Illinois , including plant clerical employees but excluding office clerical employees , guards, professional employees, and supervisors as defined in the Act.] 'In its exceptions , the Intervenor requested oral argument before the Board. Because the exceptions , in our opinion , adequately express the position of the Intervenor , the request is hereby denied 2 Hellige, Inc., 96 NLRB 1216. 9In view of our decision on this point, we deem it unnecessary to consider the Intervenor's objections on the merits. 107 NLRB No 13. 1 Copy with citationCopy as parenthetical citation
