Pursuant to the Direction of Elec- tion, an election by secret ballot was conducted on , November 28, 1941, under the direction and supervision of the Regional Director for the Fourteenth Region (St.,Louis, Missouri). On December 1, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. L R B 768 38 N. L. R. B., No. 166. 925 926 DECISIONS OF NATIONAL LABOR RELATIONS BOARD On January 24, 1942, the Regional Director issued his Report on Objections. The Board has considered the Election Report, the objections thereto, and the Regional Director's Report on Objections, and finds that the objections do not raise substantial and material issues in respect to the conduct of the ballot or the Election Report. The objections are hereby overruled. The results of the election show that no collective bargaining repre- sentative has been selected by a majority of the employees of Walsh Refractories Corporation, Vandalia, Missouri, in the unit heretofore found to be appropriate for collective bargaining. We shall there- fore dismiss the petition for investigation and certification of employees of the Company. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of Na- tional Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY ORDERED that the petition for investigation and cer- tification of representatives of employees of Walsh Refractories Corporation, Vandalia, Missouri, filed by United Brick and Clay Workers of America, Local No. 806, affiliated with the American Federation of Labor, be, and it hereby is, dismissed.
