Case.No. R-8165 SUPPLEMENTAL DECISION AND' CERTIFICATION OF REPRESENTATIVES March 18; 1942 On December 18, 1942, 'the National Labor Relations • Board, herein called the Board, issued its Decision and Direction of Election in the above-entitled proceeding.' Pursuant to the Direction of Election. an election by secret ballot was conducted on January,15, 1942, under the direction and supervision of the Regional Director for the Thir- teenth Region (Chicago; Illinois). On January 20, 1942, the Re-, gional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. As to the balloting and the results thereof, the Regional Director reported as follows : Total number on eligibility list----------------------------- 319 Total number of ballots cast--------------------------------- 293 Total number of ballots challenged--------------------------- 21 Total number of blank ballots------------------------------- 0 Total number of void ballots-------------------------------- 0 Total number of ballots counted------------------------------ 272 Number of ballots voted for Warehouse & Distribution Workers Union, C. I. 0------------------------------------------- 153 Number of ballots voted for Chicago Drug Workers Associa- tion ------------------------------------------------------- 114 Number of ballots voted for neither--------------------------- 5 Since the number of the challenged ballots cannot affect the result of the election, the Regional Director ruled that they would not be counted. B., No. 179. 920 WALGREEN COMPANY 921 On January 26 and 28, 1942, respectively, Walgreen Company, herein called the Company, and Chicago Drug Workers Association, herein called the Association-Independent, each filed objections to the conduct of the election and to the Election Report. On February 23, 1942, the Regional Director issued his Report on Objections which was duly served upon the parties. The Board has considered the objections filed-by the Compan 'and the Association and finds that the objections raise no substantial or material issues in respect to the conduct of the election or the Election Report. The objections are hereby overruled.' - By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY CERTIFIED that Chicago Drug Workers Association, affiliated with the Warehouse & Distribution Workers Union, affiliated with the I. L. W. U., has been designated and selected by a majority of all employees at the Chicago warehouse of Walgreen Company, Chicago, Illinois, excluding supervisory employees, watchmen, and employees in the personnel department, as their representative for the purposes of ,collective bargaining and that, pursuant to Section 9 (a) of the National Labor Relations Act, Chicago Drug Workers Asso- ciation, affiliated-with the Warehouse & Distribution Workers Union, affiliated with the I. L. W. U., is the exclusive representative of all such employees for the purposes of collective bargaining in -respect to rates of pay, wages, hours of employment, and other conditions of employment.
