A Paddock, of Roanoke, Va , for the Company Mr Lee Pressman, of Washington, D C, for the Union Cllr George H Gentitlaes, of counsel to the Board DECISION AND CERTIFICATION OF REPRESENTATIVES STATEMENT OF THE CASE Upon petition duly filed by Steel Workers Organizing Committee, herein called the Union, alleging that a question affecting commerce had arisen concerning the representation of employees of Virginia Bridge Company, herein called the Company, engaged in the fabrica- tion of steel products at plants located in Virginia, Tennessee, and Alabama, the National Labor Relations Board provided for an ap- propriate hearing upon due notice -On May 7, 1942, before a hearing was held, the Company, the Union, and the' Regional Director for the Sixth Region (Pittsburgh, Pennsylvania) enteied into a "Stipula- tion for Consent Elections and Ceitification by National Labor Rela- tions Board " Pursuant to the stipulation an election by secret ballot was con- ducted on May 12, 1942, under the direction and supervision of the Regional Director among all employees of the Company's Birming- ham plant, Birmingham, Alabama, except salaried or clerical em- ployees, draftsmen, drafting engineers and designers, foiemen, as- sistant foremen, or supervisors in charge of any classes of labor, or watchmen, or guai ds, to determine whether or not they desu ed to be represented by the Union On May 21, 1942, the Regional Direc- tor issued and duly served upon the parties an Election Report on the ballot No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. Board on July 24; 1942, issued its older granting said motion to substitute the name "United Steelworkers of )Amer ica'7 for the name,"Steel Woi hers Organizing Committee" We accordingly coil ect the caption and will certify the United Steelworkers - of America as exclusive bargaining representative , Upon the basis of the stipulation, the Election Report, and the entire record in this case, the Board makes the following : FINDINGS OF FACT 1 A question affecting commerce has arisen concerning the repre- sentation of employees of Virginia Bridge Company, Pittsburgh, Pennsylvania, within the meaning of Section 9 (c) and Section 2 (6) and (7) of the National Labor Relations Act 2 All employees at the Birmingham plant of Virginia Bridge Company, Birmingham, Alabama, except salaried or clerical em- ployees, draftsmen, drafting engineers and.designers, foremen, assist- ant foremen, or supervisors in charge df`any=classes of labor, or watch- men, or guards, constitute a unit appropriate for the purposes of collective baiganmg within the meaning of Section 9 (b) of the Act l 3 United Steelworkers of America has been designated and select- ed by a majority of employees in the above unit as their representative for the purposes of collective bargaining and is the exclusive repre- The parties stipulated that should the Union file a petition within six months of the date of the stipulation, to be designated exclusive bargaining' representative for the em- ployees of the Company's Roanoke plant, and should it receive a majority vote by the same classifications of eiirployees as herein described; the two-.plants shall constitute a single appropriate unit 0 1140, DECISIONS OF NATIONAL LABOR RELATIONS BOARD sentative of all employees in said unit within the meaning of Section 9 (a) of the Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section_ 9 (c) of the National Labor Relations Act, IT IS HEREBY CERTIFIED that United Steelworkers of America hag been designated and selected by a majority of all the employees at the Birmingham plant of Virginia Bridge Company, Birmingham, Alabama, except salaried or clerical employees, draftsmen, drafting engineers and designers, foremen, assistant foremen, or supervisors in charge of any classes of labor, or watchmen, or guards, as their representative for the purposes of collective baigaining and that, pursuant to Section 9 (a) of the Act, United Steelworkers of America is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment Copy with citationCopy as parenthetical citation
