See Sec. 102.65(c) and 102.67(c) of the Board’s Rules and Regulations. 2 The Employer’s request for expedited review and impoundment of the ballots is denied. This case involves the Board’s Final Rule on representation case procedures, with which Acting Chairman Miscimarra disagrees for the reasons expressed in his dissenting views in the Final Rule. 79 Fed. Reg. 74308, at 74430-74460 (December 15, 2014) (dissenting views of Members Miscimarra and Johnson). In the instant case, however, Acting Chairman Miscimarra agrees with denying review of the Regional Director’s decision to direct a mail ballot election and to deny the Employer’s request for expedited review or to impound the ballots.
