R-2205 to R-2207 incluusiive CERTIFICATION OF REPRESENTATIVES September 18, 1941 On January 4, 1941, the Board issued a Decision and Direction of Elections 1 and on January 21, 1941, an Amendment to Decision and Direction of Elections 2 in the above-entitled proceeding. Pursuant to the Direction, as amended, elections by secret ballot were conducted between February 21 and August 1, 1941, under the direction and supervision of the Regional Director for the Second Region (New York City), among employees of United States Lines Company, New York City, herein called the Company, within the three groups described below : (a) All licensed deck officers, excluding masters, employed on ves- sels operated by the Company, to determine whether they desired to be represented for the purposes of collective bargaining by National Organization Masters, Mates & Pilots of America, affiliated with the American Federation of Labor, or by United Licensed Officers, or by neither; (b) All licensed engineer officers employed on vessels operated by the Company, to determine whether or not they desired to be repre- sented for the purposes of collective bargaining by Marine Engineers' Beneficial Association, affiliated with the Congress of Industrial Organizations ; (c) All radio operators employed on vessels operated by the Com- pany, to determine whether they desired to be represented for the purposes of collective bargaining by Marine Division, Commercial Telegraphers Union, affiliated with the American Federation of 128 N. On July 31, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regula- tions-Series 2, as amended, issued and duly served upon the parties an Election Report with regard to the balloting among Groups (a) and (b) above.3 No objections to the conduct of the ballot in regard to these two groups, or to the Election Report have been filed by any of the parties. American Communica- tions Association, affiliated with the Congress of Industrial Organ- izations, filed objections thereto. Since the investigation in respect to these objections is still pending, we shall not at this time set forth the contents of the Supplemental Election Report or certify any representative upon the basis thereof. We need not, however; and accordingly shall not, withhold certification of representatives in respect to Groups (a) and (b). E The Regional Director made no report at that time regarding the balloting among Group ( c) due to the fact that the ballots thereof had not then been counted. 520 DECISIONS OF NATIONAL LABOR RELATIONS BOARD CERTIFICATION OF REPRESENTATIVES' By virtue of and pursuant to the power vested in the -National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT IS HEREBY CERTIFIED that National Organization Masters, Mates & Pilots of America, affiliated with the American Federation of Labor, has been designated and selected by a majority of all licensed deck officers, excluding masters, employed by United States Lines Company, New York City, on vessels operated by United States Lines Company, as their representative for the purposes of collective bar- gaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, National Organization Masters, Mates & Pilots of America, affiliated with the American Federation of Labor, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment. IT IS HEREBY CERTIFIED that Marine Engineers' Beneficial Associa- tion, affiliated with the Congress of Industrial Organizations, has been designated and selected by a majority of all licensed engineer officers employed by United States Lines Company, New York City, on vessels operated by United States Lines Company, as their rep- resentative for the purposes of collective bargaining, and that, pur- suant to Section 9 (a) of the Act, Marine Engineers' Beneficial Association, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages , hours of employment, and other conditions of employment.
