AND SUPERVALU INC. ORDER1 United Natural Foods, Inc., d/b/a United Natural Foods, Inc. and Supervalu, Inc.’s (UNFI) request for special permission to appeal from Regional Director Ronald K. Hooks’ February 4, 2021 Order granting the Union’s request for a 30-day continuance and rescheduling the hearing is denied. The request involves the rescheduling of the hearing regarding Case 19- CB-250856, which the Regional Director consolidated with Case 19-CA-249264. However, on February 4, 2021, the Regional Director severed the cases, withdrew the complaint in Case 19- CB-250856, and dismissed the charge in that case. In a separate Order issuing today, the Board denies UNFI’s request for special permission to appeal the withdrawal of the complaint allegations against Teamsters Locals 117 and 313. In addition, even if those arguments were not moot, and to the extent that they apply to Case 19-CA-249264, Section 102.16 of the Board’s Rules and Regulations authorizes the Regional Director to extend the hearing date when, as in this case, more than 21 days remain before the scheduled hearing.
