ORDER Granting Joint Motion to Withdraw Petition 37 C.F.R. § 42.71 IPR2020-00384 Patent 6,954,634 2 Samsung Electronics America, Inc. (Petitioner) filed a Petition for inter partes review of U.S. Patent No. 6,954,634 (Ex. 1001). Paper 1. Uniloc 2017 LLC (Patent Owner) filed a Preliminary Response. Paper 8. On May 28, 2020, we authorized the parties via email to file a joint motion withdrawing the Petition. On June 8, 2020, the parties filed a Joint Motion to Withdraw Petition. Paper 11 (“Motion”). In the Motion, the parties represent that they have reached an agreement to resolve all currently pending Patent Office and District Court proceedings between the parties involving the above-identified patent. Motion 1. The parties further state that the District Court has granted their joint motion to dismiss the related litigation. Id. The parties jointly move to withdraw the Petition pursuant to 37 C.F.R. § 42.71(a) and to terminate this proceeding. Id. This proceeding is at an early stage and we have not yet decided whether to institute a trial. In the circumstances present here, we determine it is appropriate to dismiss the Petition and terminate the proceeding to promote efficiency and minimize unnecessary costs. Therefore, the parties’ Joint Motion to Withdraw Petition is granted. This Order does not constitute a final written decision pursuant to 35 U.S.C. § 318(a). ORDER Accordingly, it is ORDERED that the Parties’ Joint Motion to Withdraw Petition is granted; and FURTHER ORDERED that the Petition is dismissed, and IPR2020- 00384 is terminated.
