The parties filed a joint motion for a judgment that an interference did not
exist between Murata’s Claims 1-5 and Avago’s Claims 16-20. Paper 28. That
motion was granted. Paper 31. It is appropriate, therefore, to enter judgment.
Accordingly, it is
ORDERED that the subject matter of Murata’s involved Claims 1-5 and 1
Avago’s involved Claims 16-20 do not interfere; 2
FURTHER ORDERED that the Office is authorized to issue a patent to 3
Avago including Claims 16-20 of involved Application 12/215,950; 4
FURTHER ORDERED that a copy of this judgment be made of record in 5
the files of Application 12/215,950, and Patent 7,868,519; and 6
FURTHER ORDERED that if there is any settlement agreement or related 7
documents which have not been filed, attention is directed to 35 U.S.C. § 135(c) 8
and 37 CFR § 41.205. 9
