Employer and SERVICE EMPLOYEES INTERNATIONAL UNION LOCAL 503, OREGON PUBLIC EMPLOYEES UNION Petitioner Cases 36-RC-6520 36-RC-6521 DECISION AND ORDER The National Labor Relations Board has considered objections and determinative challenged ballots in a mixed manual and mail ballot election held June 15, 2011 and June 16, 2011, and the Regional Director's report recommending disposition of them.1 The election was conducted pursuant to a Stipulated Election Agreement. The eligible voters in Voting Group A voted a two-part ballot with two questions appearing on their ballot: “Do you wish to be included with nonprofessional employees in a single unit for the purpose of collective bargaining?†and, “Do you wish to be represented for the purpose of collective bargaining by Service Employees International Union Local 503, Oregon Public Employees Union?†The tally of ballots for the first question was served upon the parties on June 29, 2011, which showed that a majority of the valid votes cast by Voting Group A were cast for inclusion with nonprofessional employees in a single unit for the purpose of collective bargaining. 1 The mail portion of the election was conducted from June 15, 2011 through June 29, 2011. 2 The ballots for Voting Group A were then commingled with the ballots for Voting Group B to determine the outcome of the second question posed to Voting Group A, which was the same question posed to Voting Group B. The tally of ballots shows 58 ballots cast for and 58 ballots cast against the Petitioner, with 1 void ballot and 2 challenged ballots, a sufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations. ORDER IT IS ORDERED that the Officer in Charge for Subregion 36 shall, within 14 days of this decision, open and count the ballots of Sean Looman-Nelson and Emily Swancuff, and thereafter prepare and serve on the parties a revised tally of ballots, and issue the appropriate certification.
