Pursuant to the Direction of Election, an election by secret ballot was conducted on April 3, 1942, under the direction and supervision of the Regional Director for the Twenty-first Region (Los Angeles, California). On April 4, 1942, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2), as amended, issued and duly served upon the parties his Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. B., No. 127. 763 764 DECISIONS OF NATIONAL LABOR RELATIONS BOARD California , excluding part-time, , emergency, and relief drivers, as their representative for 'the purposes of collective bargaining, and that, pursuant to Section 9 (a) of they National Labor Relations Act, Los Angeles Newspaper Guild, CIO , is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other con- ditions of employment. In the Matter of TRIANGLE PuBLICATION s, INC. and Los ANGELES NEWSPAPER GUILD, CIO Case No. R-3421 SUPPLEMENTAL DECISION May 2, 1942 Pursuant to 'our Direction of Election in the above -entitled pro- ceeding,' the Regional Director for the Twenty -first Region (Los Angeles, California ) on April 3, 1942, conducted an election, and on April 4 , 1942, issued and duly served upon the parties his Election Report.- No objections- to the conduct '- of the election or the Elec- tion Report having been filed by any of the parties within 5 days thereafter , as provided by Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, the Board on April 20, 1942, issued its Certification of Representatives 2 on the basis of said Election Report. On April 17 , 1942, counsel for the Company filed with the Regional Director Objections to Election Report stating that, while the Elec- tion Report had been served upon the Company , counsel was not advised of the issuance thereof until April 16, 1942. On April 20, 1942, the Regional Director issued and served upon the parties his Report on Objections recommending that said Objections be over- ruled, and on April 22, 1942, the Guild by answer took exception to the filing of said Objections . Although the Objections to Election Report on behalf of the Company were not filed in accordance with our Rules and Regulations , we have considered the Objections which are directed against our decision finding the existence of a question of representation and determining the appropriate bargaining unit. We find that the Objections raise no substantial and material issues in respect to the Election Report, and accordingly that they do not affect the validity of our certification of Los Angeles Newspaper Guild, CIO , as the exclusive representative of the employees of Triangle Publications , Inc., in,the appropriate unit.
