Employer and LOCAL 805, INTERNATIONAL BROTHERHOOD OF TEAMSTERS Petitioner Case 29-RC-072936 DECISION AND CERTIFICATION OF RESULTS OF ELECTION The National Labor Relations Board has considered challenged ballots in a mixed manual and mail ballot election held on March 5, 6 and 7, 2012, and Regional Director's report recommending disposition of them.1 The election was conducted pursuant to a Stipulated Election Agreement. The revised tally of ballots shows 100 ballots cast for and 100 ballots cast against the Petitioner, with 14 void ballots and 2 sustained challenged ballots, an insufficient number to affect the results. No exceptions have been filed to the Regional Director's report within the time provided. Accordingly, the Board adopts the Regional Director's findings and recommendations. 1 The mail ballot portion of the election was conducted on March 7, 2012. The mail ballots were commingled with the manual ballots and counted on March 23, 2012. 2 CERTIFICATION OF RESULTS OF ELECTION IT IS CERTIFIED that a majority of the valid ballots have not been cast for Local 805, International Brotherhood of Teamsters, and that it is not the exclusive collective- bargaining representative of these bargaining unit employees Dated, Washington, D.C., June 14, 2012.
