Case No. R-2645 CERTIFICATION OF REPRESENTATIVES November 7, 1941 On August. 5, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' On September 17 and October 4, 1941, respectively, the Board issued a Supplemental Decision and Order 2 and a Second Supplemental Decision, Order, and Second Direction of Election.3 Pursuant to the Second Direction of Election, a run- off election by secret ballot was conducted on October 15, 1941, under the direction and supervision of the Regional Director for the Tenth Region (Atlanta, Georgia). On October 21, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties a Supplemental Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the parties. B., No. 167. 796 THE GREAT ATLANTIC & PACIFIC TEA COMPANY 797 CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT js HEREBY CERTIFIED that United Retail and Wholesale Em- ployees of America, affiliated with the Congress of Industrial Organ- izations, .has been designated and selected by a majority of all warehouse employees of the Great Atlantic & Pacific Tea Company, Atlanta, Georgia, including truck drivers and helpers and tahe four colored porters in the bakery shop, but excluding all other employees in the bakery shop, supervisory and clerical employees, and butchers, as their representative for the purposes of collective bargaining and that pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, United Retail and Wholesale Employees of America, affiliated with the Congress of Industrial Organizations, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
