ORDER
Employer’s Request for Review of the Acting Regional Director’s Decision and
Direction of Election raises a substantial issue with regard to the Acting Regional
Director’s finding that the benefits administrator is not a confidential employee. The
Board concludes, however, that the issue can best be resolved through the use of the
challenge procedure. Accordingly, the Acting Regional Director’s Decision is amended
to permit the benefits administrator to vote by challenged ballot, and the Employer’s
Request for Review is denied.
