Case No. R-3025 SECOND SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES July 17, 1942 On October 31, 1941 , the National Labor Relations Board, herein called the Board , issued a Decision and Direction of Election in the above-entitled proceeding 1 Pursuant to the Direction of Election, an election by secret ballot was conducted on November 21, 1941, under the direction and supervision of the Regional Director for the Fifth Region ( Baltimore , Maryland ). On April 18,'1942, the Board issued a Supplemental Decision and Direction 2 in which, among other things, the Board directed the Regional Director to open and count four chal- lenged ballots . On April 27, 1942 , pursuant to the Supplemental De- cision and Direction , the Regional Director , acting pursuant to Article III, Section 9, of National Labor Relations Boaid Rules and Regu- lations-Series 2, as amended , issued and duly served upon the parties a Supplemental Election Report , setting forth that on April 24, 1942, the Regional Director opened the ballots , and that upon a count of said ballots the results of the election were as follows: Total on eligibity list---------------------------------------- 67 Total ballots cast------------------------------------------- 56 Total ballots challenged-------------------------------------- 0 Total blank ballots------------------------------------------ 0 Total void ballots------------------------------------------- 0 Total valid votes counted------------------------------------ 56 Votes cast for Cleaners and Laundry Workers Union, Local 188 B, A C W A (C I O) ----------------------------------- 29 Votes cast against Cleaners and Laundry Workers Union, Local 188 B, A C W A (C I O)-------------------------------- 27 186NLRB 585 2 40 N L R B 729 42 N L R R, No 121 589 590 DECISIONS OF NATIONAL LABOR RELATIONS BOARD On May 4, 1942, the Companies filed Objections to Issuance of Certificate of Representation. On May 8 and 19, 1942, the Regional Director issued a Report and Supplemental Report on Objections, respectively, in which he found the Companies' contentions to be with- out merit. 'On May 26, 1942, the Companies filed a Reply to Report and Supplemental Report of the Regional Director for the Fifth Region on Objections to Issuance of Certificate of Representation and re- quested therein a further hearing. The Board has considered the Regional Director's Supplemental Election Report, the Companies' Objection: to Issuance of Certificate of Representation, the Regional Dnector's Report and Supplemental Repoit on Objections, and the Companies' Reply to Report and Supplemental Report of the Regional Director for the Fifth Region on Objections to Issuance of Certificate of Representation, and finds the Companies' Objections and Reply to be without merit. The request for a further heaiing is hereby denied. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat 449, and pursuant to Aiticle III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Seiies 2, as amended, IT IS HEREBY CERTIFIED that Cleaners and Laundry Workers Union, Local 188 B, A C W. A (C. I 0 ), has been designated and selected by a majority of all production and maintenance employees of Joseph L Fradkin and Ben Singer, a partnership, tiading as the American Linen Service Co. and the American Laundries, Inc (a subsidiary and affiliate of the American Linen Service Co ), Washington, D C, in- cluding truck drivers, but excluding office, cleiical, and supervisory employees, as their representative for the put poses of collective bar- gaining and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Cleaners and Laundry Workers Union, Local 188 B, A. C W. A. (C. I. 0 ), is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
