DECISION AND ORDER
On June 11, 2012, the Acting Regional Director for Region 32 of the
National Labor Relations Board issued her Report and Recommendations on
Objections and Notice of Hearing, in which she recommended overruling the
Petitioner’s Objections Nos. 1, 2, 9, 14, and 16 through 20, and setting for
hearing the Petitioner’s Objections Nos. 4 through 8, 10, 11, 13, 15, and 21
through 24.
The election, which was held on November 17, 2011, was conducted
pursuant to a Stipulated Election Agreement. The tally of ballots shows 31
ballots cast for and 41 ballots cast against the Petitioner, with 6 challenged
ballots, an insufficient number to affect the results.
The Employer filed timely exceptions to the Acting Regional Director’s
Report and Recommendations. On July 24, 2012, the Employer filed a Motion to

withdraw its Exceptions to the Acting Regional Director’s Report and
Recommendations. The Employer’s Motion to withdraw its Exceptions is hereby
granted.1
Accordingly, as there are no exceptions pending before the Board and the
time allowed for such filing having expired, the Board adopts the Acting Regional
Director’s findings and recommendations.
ORDER
IT IS ORDERED that this proceeding is remanded to the Regional Director
for Region 32 for further appropriate action consistent with the Acting Regional
Director’s report.
