TERMINATION Settlement 35 U.S.C. § 317 and 37 C.F.R. § 42.72 On June 29, 2015, the parties filed a joint motion to terminate this inter partes review proceeding. Paper 15 (“Mot.”). In connection with their request to terminate, the parties filed a copy of a written settlement agreement, and asked that it be kept confidential under the provisions of 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c). Paper 16. IPR2015-00166 Patent 6,502,030 B2 2 Trial in this proceeding was instituted on May 22, 2015 (Paper 11), and is in a preliminary stage. A patent owner response has not yet been filed. The parties represent they have resolved all issues relating to the patent challenged in this proceeding and have agreed to dismiss, with prejudice, the related co-pending district court litigation. Mot. 1–2 (referencing Ex. 1018, “Confidential Settlement Agreement”). Although there is another inter partes review proceeding involving the challenged patent, IPR2015-01043, the petitioner here is not a party to that other proceeding. Under these circumstances, we determine that it is appropriate to terminate the trial in this proceeding without rendering a final written decision. See 37 C.F.R. § 42.72. Accordingly, it is ORDERED that the joint motion to terminate this proceeding is granted; FURTHER ORDERED that the joint request for the settlement agreement (Ex. 1018) to be treated as business confidential information and to be kept separate from the patent files, pursuant to 35 U.S.C. § 317(b) and 37 C.F.R. § 42.74(c), is granted; and FURTHER ORDERED that this proceeding is hereby terminated.
