Paper 22. IPR2020-01271 Patent 9,239,686 B2 2 In an e-mail dated November 17, 2021, we authorized HP Inc. (“Petitioner”) and Synkloud Technologies, LLC (“Patent Owner”) to file a motion to terminate the instant proceeding. On November 22, 2021, and pursuant to 35 U.S.C. § 317 and 37 C.F.R. § 42.74, Petitioner and Patent Owner filed a joint motion to terminate this proceeding and a joint request to have their settlement agreement (Exhibit 2040) treated as confidential business information under 35 U.S.C. § 317 and 37 C.F.R. § 42.74. Papers 23, 24. In the joint motion, the parties represent that the settlement agreement is with “regard to the patent[] at issue in [this] proceeding[]” and is a true and correct copy. Paper 23, 2–3.2 At this juncture of the proceeding, the Board has not entered a final decision. Based on the facts presented in this case, we determine that it is appropriate to terminate the proceeding. Accordingly, it is: ORDERED that the joint request that the settlement agreement be treated as business confidential information to be kept separate from the patent files (Paper 24) is granted; FURTHER ORDERED that the joint motion to terminate the proceeding (Paper 23) is granted; and FURTHER ORDERED that the proceeding is terminated. 2 The pages of the motion are not numbered.
