May. 19, 2016) Copy Citation Re: Sutter East Bay Hospitals d/b/a Alta Bates Summit Medical Center Cases 32-CA-024459; 32-CA-024469; 32-CA-024470 ORDER By decision dated July 24, 2012, the United States Court of Appeals for the District of Columbia Circuit enforced the Board’s July 29, 2011 Order1 to the extent that it concluded that the Respondent violated the Act by its unlawful surveillance of union activities and redefinition of its solicitation and distribution policies. The court granted the petition for review, vacated the Board’s finding that the Respondent violated the Act by disciplining and discharging employee Beverly Griffith, and remanded the case to the Board to rehear the evidence and correctly apply the appropriate legal standard with respect to that issue. Accordingly, this case is remanded to Chief Administrative Law Judge Robert Giannasi to appoint a new administrative law judge for the limited purpose of rehearing the evidence and correctly applying the appropriate standard on that issue.
