Case No. R-2581 CERTIFICATION OF REPRESENTATIVES September 13, 1941 On July 7, 1941, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceeding., Pursuant to the Direction, an election by secret ballot was conducted on July 25, 1941, under the direction and supervision of the Regional Director for the First Region (Boston, Massachusetts). On July 29, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the election or the Election Report have been filed by any of the parties.2 As to the balloting and its results, the Regional Director reported as follows : Total number eligible to vote------------------------------- 145 Total number of votes cast---------------------------------- 122 Total number of valid votes--------------------------------- 117 Total number of ballots cast in favor of United Hatters, Cap and Millinery Workers International Union, Local 88 (A. F. L.)------------------------------------------;---- 78 Total number of ballots cast against United Hatters, Cap and Millinery Workers International Union , Local 88 (A. F . L.)_ 39 Total number of blank ballots ------------------------------- 0 Total number of void ballots-------------------------------- 0 Total number of challenged ballots--------------------------------- 5 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 133 N. L . R. B. 140. 2 On July 19 , 1941, Sussex Hats, Inc , filed a motion requesting postponement of the election on the ground that a substantial number of its eligible employees would be un- available to participate therein. Since the Election Report, as hereinafter set forth, shows that only 23 of the 145 eligible employees failed to vote in the election and that their votes could not affect the results of the election , the motion is hereby denied. 35 N. B., No. 89. 422 SUSSES HATS IN C. 423 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that United Hatters, Cap and Millinery Workers International Union, Local 88 (A. F. L.), has been desig- nated and selected by a majority of the production employees of Sussex Hats, Inc., Holyoke, Massachusetts, including packers and shippers, but excluding executives, foremen, foreladies, assistant foreman, assistant foreladies, designers, and maintenance and clerical employees, as their representative for the purposes of col- lective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, United Hatters, Cap, and Millinery Workers International Union, Local 88 (A. F. L.), is the ,exclusive representative for all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment and other conditions of employment.
