In a concurrent paper, we determined that all of Smart’s involved 1
claims are unpatentable under 35 U.S.C. § 112, first paragraph, for lack of 2
written description in the specification. Smart is therefore without standing 3
to continue in the interference. 4
Accordingly, it is 5
ORDERED that judgment is entered against Smart for Count 1 6
(Interference 105,846 Paper 1) and Count 2 (Interference 105,861 Paper 1); 7
FURTHER ORDERED that claims 174-294, 296, 297, 299, 300, 8
302, 304-314, 316-319, and 321-325 (corresponding to Count’s 1 and 2) of 9
Smart Application 10/818,920 are finally refused (35 U.S.C. § 135(a)); and 10
FURTHER ORDERED that a copy of this judgment be entered in 11
the administrative records of Patent 7,671,295, Patent 7,482,551, and 12
Application 10/818,920. 13
